Judge Stops Construction At Indian Burial Site

LAKESIDE, Calif. -- Further construction on a reservoir and pumping station on an Indian burial site on Lakeside's south side was stopped by a judge.
San Diego Superior Court Judge Judith Hayes late Wednesday granted a request for a permanent injunction.
The Native American Heritage Commission sought the injunction to stop construction of the Padre Dam Municipal Water District water project near Lake Jennings Park Road and Old Highway 80.
So far, 13 human bones belonging to as many as eight people have been unearthed, along with more than 200 other bone fragments that are likely human, according to the Viejas Band of Kumeyaay Indians.
The commission has declared the entire 2.5-acre site an officially sanctioned Native American cemetery and ceremonial ground.
According to the Kumeyaay tribe, the Padre Dam's own experts had advised them in 2007 to avoid the site because of the likelihood of unearthing significant Native American cultural resources.
The Padre Dam Municipal Water District had begun developing the project before human remains and Native American artifacts were unearthed. Hayes issued a temporary restraining order June 7.
