CSAC’s policy with respect to gaming on restored lands is one that reflects the importance of local government and individual tribal government relationships and the uniqueness of each local situation. Specifically, CSAC opposes the practice commonly referred to as “reservation shopping” where a tribe seeks to place land into trust outside its aboriginal territory over the objection of the affected county.

That letter, obtained through a FOIA request, appears to indicate that at a meeting in June of 2009, Assistant Secretary Echohawk or his staff leaked to the Tribe a draft opinion granting the restored lands exception.

Restored lands are re-acquired land, land that a tribe has historically inhabited since time immemorial and exercised governance over. Point Molate has never been a Reservation, Rancheria, Indian lands or continuously inhabited by the Guidiville Band since time immemorial.

The problems in Richmond only evidence the many systemic flaws in the current process for taking land into trust, including a lack of clearly defined standards for trust land acquisitions, the absence of transparency in the land acquisition process including notice to and meaningful participation by local governments and the public, no open process or finite standards for determining whether new lands qualify for gaming as "restored lands" under the Indian Gaming Regulatory Act, and no requirement for intergovernmental agreements between tribes and local governments. The Guidiville Indian Rancheria has its historical, archeological, geographical and cultural roots at the Guidiville Rancheria, located in Talmage, Mendocino County, near Highway 101, South of Ukiah, in California, approximately 110 miles from the proposed casino site.

ESA performed a technical peer review of the Point Molate Mixed-Use Tribal Destination Resort
and Casino Project Draft Environmental Impact Statement/Environmental Impact Report (Draft
EIS/EIR). The review was conducted to determine technical adequacy in meeting the statutory
requirements of the National Environmental Policy Act (NEPA) and California Environmental
Quality Act (CEQA). ESA scientists and specialists reviewing the document included senior planners,
biologists, air quality/noise specialists, traffic engineers, hydrologists, geologists, and
archeologists/historians, all who have considerable experience in the preparation of joint
NEPA/CEQA documents.

The Regional Director has declined to intervene in a membership dispute within the Guidiville Rancheria of California and remanded the matter to the Tribe for further consideration of the claim. While the Pacific Regional office has dismissed the current appeal for lack of jurisdiction, the Regional Director goes on to state: "...the dispute could possibly evolve into a problem concerning government to government relations, down the line in which case it might be necessary for BIA to intervene. The Regional Director expressed concern that there may be serious questions as to whether due process and equal protection in accordance with ICRA and strongly suggested that the Tribe reconsider all the facts in this case and re-evaluate its position.

In 2003 the Department of the Navy and the San Francisco Bay Area Regional Water Board entered into a covenant to restrict use of the property at the former Naval Fuel Depot at Point Molate.
The Dept. of the Navy and the Water Board have further concluded that certain uses and activities need to be prohibited within Disposal Areas 1,2,6,11,12. Shall not be used for a residence for use as residential human habitation nor hospitals for humans, schools for persons under 21 years of age, day care centers for children or any permanently occupied human habitation.
