April 2008 Pending Gaming Aquisititions

In 2007, Tribes in California had 21 pending federal applications for the acquisition of new land for tribal gaming. Twelve (57%) of these applications seek to by-pass the two-part determination before opening new casinos. By comparison, there are 37 applications in all other states for the acquisition of new land for tribal gaming, only three of which (8%) seek to by-pass the two-part determination. December of 2008, California now has approximately 12 gaming applications, several applications were approved, three of these are embrolied in significant litigation. A few applications were denied based on incomplete information or inconsistancies with a new Department of the Interior policy outlined in what has become known as the Artman Memo on Comutable Distance.
