Nov. 4, 2013: Senator De Leon holds Legislative Work Group Hearing
I write to invite all interested stakeholders to attend the first meeting of the Senate Working Group on Off-Reservation Indian Gaming Agreements which will examine policy and procedural implications associated with agreements which permit Native American Tribes to conduct gaming on land acquired outside of the tribe’s traditional reservation or other trust lands. The first meeting of the working group will be held on Monday, November 4, 2013 at 1pm in Room 4203 of the State Capitol in Sacramento. All interested stakeholders are invited to attend this first meeting and provide comments regarding recommendations for improving the process for approving off-reservation gaming agreements. This first meeting will be critical in helping the working group identify the key issues that should be prioritized in the effort. The legislature this year passed a first of its kind off-reservation compact with AB 277 (Hall) the North Fork Rancheria Compact. While I ultimately voted for the compact, I became deeply concerned with the process associated with this vote. I believe a better process, with true oversight and review, would create better results for all parties involved. As I firmly support and respect a tribe’s need for self-sufficiency, I want to assure all stakeholders that the efforts of the working group will be focused on how we can have a better process for approving off-reservation agreements. This is a critical time for California to establish its own set of policies and recommendations to ensure that future off-reservation agreements are reviewed based on consistent criteria. Dear Justice Partners: Proposed California Rule of Court, rule 10.60, which would formally establish the California Tribal Court/State Court Forum (forum) as a Judicial Council advisory committee, is now circulating for comment. The comment period is very short, from July 30, 2013 – August 30, 2013. At its meeting on April 25, 2013, the Judicial Council approved the Report and Recommendations to Improve the Governance, Structure, and Organization of Judicial Council Advisory Groups submitted by the Rules and Projects Committee (RUPRO), the Executive and Planning Committee (E&P), and the Technology Committee (JCTC). Among the recommendations were the establishment of two advisory committees: The Tribal Court/State Court Forum and the Court Security Advisory Committee. Another recommendation accepted by the council was repeal of the rules concerning the Judicial Services Advisory Committee (rule 10.57), the Working Group on Court Security (rule 10.170), and the Working Group on Court Security Fiscal Guidelines (rule 10.171). All comments received will become part of the public record surrounding the decision whether to adopt a rule institutionalizing the forum. SB 190: Senator Wright - Sports Wagering
This bill would authorize the owner or operator of a gambling establishment, or the owner or operator of a horse racing track, including a horse racing association, or of a satellite wagering facility, with a current license, to conduct wagering on professional and collegiate sports or athletic events, other than on collegiate sports or athletic events that take place in California or in which any California college team participates, by applying to the California Gambling Control Commission or the California Horse Racing Board, as specified, for authorization to conduct sports wagering, and by paying an annual fee for deposit in the Gambling Addiction Program Fund. The bill would require each licensed entity to remit to the treasurer on a monthly basis for deposit in the general fund, an amount equal to 7.5% of its gross revenues. The bill would require the commission, the board, and the department to adopt regulations to implement these provisions, including authority to adopt regulations establishing fees in a reasonable amount to recover costs incurred performing their duties pursuant to these provisions. This bill contains other related provisions and other existing laws.
